Simplifying Deceased Estates Transfers
When a loved one passes away, there’s more to deal with than just grief; the practical aspects of settling their affairs can be complex and challenging. The property, money, and debts they leave behind collectively form their estate, and navigating this process, even with a will, can be a lengthy and intricate journey.
Here we have outlined the key steps in the settlement process to ease you into dealing with deceased estate settlements:
property ownership.
- One critical aspect of estate settlement is property ownership. To transfer or sell a deceased person’s property to either a third party, the estate’s beneficiaries or to transfer the deceased joint tenants share into the name of the surviving joint tenant (Survivorship Application), the deceased individual’s name must be removed from the property title. A survivorship application estate settlement transaction is the method by which the property is transferred to the surviving joint-tenant, or through a transmission application if the property is to be transferred into the names of the administrator, or the executor so that they can transfer the property to the estate beneficiaries under the Will.
If You’re an administrator or executor
- If you find yourself in the role of administrator or executor, the responsibility of ensuring the deceased person’s property is appropriately sold or transferred falls on your shoulders. To initiate this process, you’ll need to submit a transmission application to Landgate for approval. Once this application is granted, the property’s ownership is legally transferred to you as the executor, allowing you to manage their affairs and distribute their assets in accordance with their wishes.
If You Are a Surviving Joint Tenant
- If you find yourself as the co-owner of the Joint Property as a joint tenant, then a survivorship application needs to be made to Landgate so that the deceased joint tenant can be removed from the title and their property interest transferred into the surviving joint tenant’s name.
